Since the 2018 Farm Bill allowed for hemp with less than 0.3% Delta-9 THC, synthetic THC products like Delta-8 have gained popularity across the United States. Utah has taken a proactive approach by incorporating these products into its regulated cannabis framework, placing controls on production, sale, and public health standards.

  1. Regulation of Hemp-Derived Intoxicants Utah regulates intoxicating hemp products by treating them as part of its cannabis program. This means synthetic cannabinoids, including Delta-8 THC, are subject to the same regulatory standards as medical cannabis products, ensuring consistent oversight and compliance. By categorizing these products similarly to other cannabis items, the state enforces strict guidelines for production, distribution, and consumer access.
  2. THC Potency Limits Utah enforces potency limits on synthetic cannabinoids in alignment with its cannabis regulations. Synthetic THC products, including Delta-8, are restricted to a maximum of 10 mg of THC per serving and 100 mg per package. These limits align with those set for medical cannabis products, ensuring consistency and consumer safety.
  3. Public Health Measures Synthetic THC products in Utah are subject to comprehensive public health regulations, including child-resistant packaging, age restrictions, and detailed labeling requirements, mirroring standards applied to medical cannabis to prioritize consumer safety.
  4. Enforcement Mechanisms Against Unregulated Sales Utah enforces its synthetic THC regulations with measures such as license revocations, fines, and product seizures.
  5. Advertising and Marketing Restrictions Synthetic THC products in Utah are subject to advertising and marketing restrictions aligned with cannabis laws. This includes limits on marketing that could appeal to minors and restrictions on promotional activities, ensuring responsible advertising practices.
  6. Responsible State Agency The Utah Department of Health and Human Services is responsible for regulating synthetic THC products within the state’s cannabis framework. This agency enforces standards for safety, licensing, and consumer protection to ensure comprehensive oversight.
