Indiana has adopted a strict stance on synthetic THC products, including Delta-8 and Delta-10 THC, following the 2018 Farm Bill. Indiana prohibits the production, sale, and possession of synthetic THC, classifying these substances as controlled.

3Chi Legal Challenge in Indiana

In Indiana, the hemp company 3Chi and the Midwest Hemp Council filed a lawsuit against Indiana Attorney General Todd Rokita following his 2023 opinion declaring Delta-8 THC and other synthetic cannabinoids as controlled substances under state law. 

Entitled Midwest Hemp Council & 3Chi, LLC v. Rokita, Case No. 1:23-cv-00898-SEB-TAB (S.D. Ind. 2023)., the plaintiffs argue that Delta-8 THC products derived from hemp are federally legal under the 2018 Farm Bill, challenging the state’s authority to regulate these products as controlled substances.
