How would rescheduling impact interstate trade?
Interstate transport of marijuana will not change as a result of rescheduling. Because the FDA does not approve of the distribution of marijuana, transporting what the agency might consider “adulterated” products that contain marijuana might still have legal challenges (even if they are Scheduled as III instead of I), and the FDA could even seek enforcement help from the Department of Justice for enforcement. It is unclear how aggressively the FDA might try to intervene. In terms of the common carriers like FedEx or UPS, marijuana would still be a controlled substance, and none of the carriers other than the US Postal Service will transport controlled substances.
